PUBLIC NOTICE ADVERTISEMENT FOR BIDS FOR THE SALE OF LAND OWNED BY THE BOROUGH OF EMMAUS Pursuant to Section 1201.1 of the Pennsylvania Borough Code ("Code"), the Borough of Emmaus ("Borough") is offering for combined sale only by sealed bid to the highest bidder, the following real property ("Property"): 33 East Minor Street, Emmaus, PA 18049, PIN 549487016062 (former Borough office) 10 East Minor Street, Emmaus, PA 18049, PIN 549487305574 (adjacent parking lot) The Property will be sold in fee simple, subject to the existing easements. (Subject to existing leases and easements.) The bidder shall submit one bid, combining the total dollar amount to be paid for both tracts. A bid for one tract, only, will be rejected. The bid shall state with specificity the actual bid amount in both word and numeric forms. The bid must be in the minimum amount of Three Million Four Hundred dollars ($3,400,000) The Bidder shall execute within ten (10) days of award by Council to the Borough an Agreement for the Sale of Real Estate ("Agreement") buying the property "as is," a copy of which is available at the Office of the Borough Manager. All real estate transfer taxes, if any, will be paid by the buyer. The Agreement may be obtained in person or by telephone request. The Agreement is not subject to modification and shall be executed without changes. Buyer shall also pay within ten (10) days of award of the bid the sum of $75,000.00 down payment which shall be nonrefundable except for marketable title issues. Any interested party may contact the Borough Manager for an appointment to inspect the existing building and land prior to the bid opening. All Borough records regarding the land for sale, such as, existing leases and easements may also be reviewed. The bid shall be mailed first class postage pre-paid, or hand delivered, in a sealed envelope to the office of the Borough Manager, Borough of Emmaus, 28 S. 4th Street, Emmaus, PA 18049. The exterior of the sealed envelope shall bear the notation "Bid - Rodale Building" The bids must be actually received in the office of the Borough Manager at or before 10:00 AM on Monday, July 20, 2020. Any bid received after that time shall be rejected. Bids will be opened by the Borough Manager in Council Chambers at 11:00 AM on Thursday, July 30, 2020. Pursuant to Section 1201.1(a.2) of the Code the sale must be consummated and paid in full within 60 days of the award bid. It is the intention of Borough Council to take action on the bids at its public meeting on Monday, August 17, 2020, or as soon as may be done. Borough Council reserves the right to reject all bids, and further reserves the right to waive all non-material defects, discrepancies or irregularities in the bids.
